Welcome to BeeFyn.in! By registering as a Laboratory (Lab) or a Freelance Phlebotomist (Phlebo) on BeeFyn.in, you agree to the following terms of use. These terms are a legal agreement between you (the Laboratory or the Phlebotomist) and BeeFyn.in (the service platform). Please read these terms carefully before proceeding.

1. Registration and Eligibility

1.1 Laboratories and Phlebotomists must be duly registered and verified by BeeFyn.in to access the platform.

1.2 By registering, you confirm that you meet all necessary requirements and qualifications, including certifications, training and any other applicable laws or regulations in your region to perform blood collection or blood testing services.

2. Platform Services

2.1 Laboratories: Laboratories define their leads for blood sample collections from their clients on BeeFyn.in. These leads will include payment details and other relevant information about the client.

2.2 Phlebotomists: Phlebotomists can express interest to perform the blood collection for any of these leads provided by a particular Laboratory; provided they have the necessary consumables, qualifications, skills and sufficient wallet balance on the BeeFyn.in platform.

3. Payment and Service Fees

3.1 Laboratories and Phlebotomists must agree to pay a platform service fee for using the BeeFyn.in platform.

3.2 The payment amount and details will be specified for each lead and should be settled directly between the Laboratory and Phlebotomist using the platform wallet, with BeeFyn.in receiving the applicable service fee.

3.3 All payments are subject to platform charges, as determined by BeeFyn.in, which may change from time to time.

4. Prepaid Service and Wallet Recharge

4.1 Both Laboratory and Phlebotomist acknowledge and agree that the BeeFyn.in platform operates on a prepaid service model. In order to accept, define or respond to any blood collection or blood testing service lead, both parties must ensure that their BeeFyn.in wallet is sufficiently funded.

4.2 Phlebotomists: Phlebotomists must have a sufficient balance in their BeeFyn.in wallet to express interest in a blood collection lead. If the balance is insufficient, the Phlebotomist will not be able to accept or initiate the expression of interest to collect that particular lead.

4.3 Laboratories: Laboratories are required to ensure that their BeeFyn.in wallet has enough funds to create or define blood collection leads for which they are seeking Phlebotomist services. If the Laboratory's wallet balance is insufficient, they will not be able to post new leads or process any requests.

4.4 Both Laboratory and Phlebotomist are solely responsible for ensuring that their wallet balances are regularly topped up to avoid any disruptions in service or the ability to use the BeeFyn.in platform. BeeFyn.in is not liable for any service interruptions resulting from insufficient wallet funds.

5. Withdrawal and Addition of Funds from BeeFyn.in Wallet

5.1 BeeFyn.in is actively working to upgrade its systems to provide a seamless and automated financial transaction process for wallet withdrawals. While this automated process is being developed, users may request a withdrawal of funds from their BeeFyn.in wallet by submitting awritten request through the available form on the website.

5.2 Withdrawal Process: Once the written withdrawal request is submitted, BeeFyn.in will process the request and remit the requested amount to the bank account details provided by the Laboratory or Phlebotomist during registration or as updated in their individual profile.

5.3 Processing Time: BeeFyn.in will remit the funds within 2-3 working days from the date of receiving the withdrawal request.

5.4 Bank Transfer Charges: Please note that all withdrawals and addition of funds to BeeFyn.in wallet, will be subject to anominal bank transfer fee , which will be deducted from the requested amount. The exact charges will depend on the bank and the transaction method used, and will be clearly communicated at the time of the request.

5.5 BeeFyn.in encourages users to keep their bank details up-to-date in their profiles to ensure smooth processing of withdrawal requests. BeeFyn.in is not responsible for delays or issues arising from incorrect or outdated bank details provided by users.

6. Verification and Liability

6.1 BeeFyn.in is not responsible for verifying the authenticity or accuracy of the leads provided by Laboratories nor for verifying the credentials, qualifications, skills or availability of Phlebotomists.

6.2 BeeFyn.in does not assume responsibility for any loss of business, damages, injuries or other liabilities arising from the use of the platform.

6.3 BeeFyn.in does not guarantee or verify the services performed by the Phlebotomists or the Laboratories. The Laboratory and the Phlebotomist are solely responsible for ensuring that they meet the required standards for service delivery.

7. Indemnification

7.1 Laboratory Indemnification: The Laboratory agrees to indemnify and hold harmless BeeFyn.in, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities or expenses (including but not limited to legal costs) resulting from any act, omission, or misrepresentation made by the Laboratory or any incident occurring due to the actions of the Phlebotomist.

7.2 Phlebotomist Indemnification: The Phlebotomist agrees to indemnify and hold harmless BeeFyn.in, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses (including but not limited to legal costs) resulting from any act, omission, or misrepresentation made by the Phlebotomist or any incident occurring due to their actions, including loss or injury to the client, client property, or any third party.

7.3 Both Laboratory and Phlebotomist agree to indemnify and hold harmless BeeFyn.in, its officers, employees, agents, and affiliates from any and all claims, damages, losses, liabilities, or expenses, including legal costs, arising from actions, negligence, or incidents that occur during or as a result of using the BeeFyn.in platform for blood collection services. This indemnification extends to anymedical expenditures, hospitalization costs or financial consequences related topartial or permanent disability, injury or loss of life that may occur during the course of availing the services facilitated by BeeFyn.in. This includes, but is not limited to, any personal harm or property loss.

8. Disclaimer of Employment Relationship

8.1 Both Laboratory and Phlebotomist acknowledge and agree that their relationship with BeeFyn.in is purely as independent contractors and nothing in these terms shall be construed as creating an employer-employee relationship. BeeFyn.in does not provide employment, insurance, or any other employee benefits to Laboratories or Phlebotomists.

8.2 BeeFyn.in is not responsible for any insurance coverage or the costs associated with medical treatment, disability, or loss of life due to any unfortunate incident or accident that may occur during the performance of services on the platform. It is the sole responsibility of both Laboratories and Phlebotomists to arrange for their own insurance, including but not limited to, medical insurance, personal accident insurance, or liability insurance to cover any potential risks related to performing blood collection services.

9. Responsibilities of Freelance Phlebotomists (Phlebotomists / Phlebos)

9.1 Phlebotomists are required to maintain proper certification, training and qualifications necessary for blood collection.

9.2 Phlebotomists must ensure they possess the required consumables (e.g., needles, syringes, gloves, masks, vials, etc.) to complete the blood collection task, as specified in each lead.

9.3 Phlebotomists are responsible for performing their duties in accordance with best practices, medical guidelines, and applicable regulations.

10. Responsibilities of Laboratories (Laboratories / Labs)

10.1 Laboratories are responsible for providing accurate and complete information regarding each lead, including client details, payment information and any special instructions for the blood collection process.

10.2 Laboratories are responsible for ensuring that all leads are legitimate and that the Phlebotomists they engage with are capable of performing the blood collection in accordance with the required standards.

11. Disclaimer of Liability

11.1 BeeFyn.in does not assume responsibility for any damages, loss of business, financial implications or legal consequences arising from actions taken by Laboratories or Phlebotomists, including but not limited to any failure to perform services, injury, loss of property or any other incidents that occur during or after the blood collection or blood testing process.

11.2 BeeFyn.in is not liable for any direct, indirect, incidental, special, consequential or punitive damages arising from the use of the platform.

12. Confidentiality and Personal Information

12.1 Confidentiality: Both Laboratories and Phlebotomists agree to maintain strict confidentiality regarding all information exchanged through the BeeFyn.in platform. This includes, but is not limited to, client information, blood collection details, medical data and any other sensitive or proprietary information related to the services provided via the platform. Neither party shall disclose, share or use such confidential information for any purpose other than the proper performance of services through the BeeFyn.in platform unless required by law.

12.2 Personal Information: By using BeeFyn.in, Laboratories and Phlebotomists acknowledge and consent to the collection, use and processing of their personal information, including but not limited to contact details, bank account information, qualifications, certifications and service records, as part of the platform's functionality. This information may be required for purposes such as account management, transaction processing and communication between Laboratories, Phlebotomists and BeeFyn.in.

12.3 BeeFyn.in's Right to Retain Personal Information: BeeFyn.in is authorized toretain a copy of all personal information pertaining to any leads processed through the platform, including but not limited to the client details, lead information, payment records and any correspondence related to blood collection or testing services. BeeFyn.in may store, process, and use this data as necessary for the operation of the platform, for improving services, and for compliance with any legal or regulatory requirements.

12.4 Privacy Compliance: BeeFyn.in agrees to handle all personal information in accordance with applicable privacy laws and its privacy policy. However, it is the responsibility of Laboratories and Phlebotomists to ensure they have obtained the necessary consents and permissions from clients for the use of their personal information during the course of providing services.

13. Termination

13.1 Right to Terminate: BeeFyn.in reserves the right to suspend or terminate the registration of any Laboratory or Phlebotomist who violates these terms and conditions, engages in fraudulent activities or fails to meet platform requirements.

13.2 User Termination: Either party may terminate their use of BeeFyn.in by providing written notice. Termination does not release the parties from any obligations that arose prior to termination. Such written notice should be sent to [email protected].

14. Governing Law and Dispute Resolution

14.1 Governing Law: These terms of use shall be governed by and construed in accordance with the laws of India.

14.2 Dispute Resolution: Any disputes arising from the use of the platform shall be resolved through binding arbitration in accordance with the rules of the appointed arbitration council, and the venue shall be New Delhi, India.

15. Changes to the Terms

15.1 BeeFyn.in reserves the right to modify or update these terms of use at any time. Such changes will be communicated to users through the platform. By continuing to use the platform after such changes are made, you agree to abide by the updated terms of use.

16. Miscellaneous

16.1 These terms of use constitute the entire agreement between the parties and supersede any prior or contemporaneous agreements or communications.

16.2 If any provision of these terms of use is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
